CHADEMA IN HIGH COURT APPLICATION SEEKING MP’S RELEASE



THE Chama Cha Demokrasia na Maendeleo (Chadema) will on Monday next week (January 16) submit to the High Court an emergency bail application and a notice of appeal for the jailed Kilombero Member of Parliament Peter Lijualikali Addressing reporters yesterday in Dar es Salaam, the party’s Lawyer Tundu Lissu said that the Chadema’s team of lawyers had started procedures to appeal by preparing a notice of appeal and an emergency bail application so as to set free the MP while waiting for the decision of the court.
According to him, however, as per national Constitution, Lijualikali would not lose his seat due to the ruling because it did not exceed six months.
He said that the party was not satisfied with the court’s decision to send the MP to jail, which was why they were seeking the High Court’s intervention.
“We as a party we believe that Lijualikali is a political prisoner. The case filed against him had political interests. Imprisonment without even a fine has been grabbed and issued for political reasons,” he said
Lissu said that the conflict with Lijualikali with the ruling party did not start last year, saying it started soon after he won the seat for Ifakara Ward a few years ago.
On Wednesday, this week, the Kilombero District court in Morogoro Region sentenced Kilombero Member of Parliament Peter Lijualikali (CHADEMA) to six months imprisonment for causing public disorder and unrest.
The 30-year old opposition legislator was immediately whisked away in the custody of law enforcers after resident magistrate Timothy Lyon handed down the sentence without the option of a fine.
Earlier, public prosecutor Dotto Ngimbwa told the court that Lijualikali, who was first respondent in the case, and his co-accused Stephano Mgata (35), committed the offence on March 1, last year, at the Kilombero Municipal hall.
According to Ngimbwa, the duo contravened Section 89 (1) of the Penal Code and Article 16 as amended during the trial. Submissions and witness cross-examinations were heard from both the prosecution and defence sides.
Magistrate Lyon concluded that the prosecution had proved beyond reasonable doubt that the accused persons committed the offence, hence the six-month jail term for the MP.
Meanwhile, the party’s Chairman Freeman Mbowe and Lissu will on Saturday this week (tomorrow) visit MP Godbless Lema who has been in remand prison for over two months now over accusations of sedition.
Lema is in Kisongo main prison following his arrest on November 2, 2016 at Parliament’s premises in Dodoma and arraignment in an Arusha court on November 8, 2016.

'NCAA rolls out payment system to ease tourism services'
The improved payment system which is due to commence on February 1, this year, will now see tour operators use special cards known as Tanzanite Card, to replace the old Smart Card.
According to information available on the authority’s website yesterday, tourists and tour operators entering Ngorongoro Conservation Area will now use Tanzanite cards, which will be issued and managed by the National Microfinance Bank (NMB) through a special account known as Wallet Account.
NCAA has also urged tour operators to open the account to enable every customer to access their details through the local bank.
“Thus, in view of the foregoing, the NCAA expects that from February 1, this year, all payment transactions will be done through your Wallet account using NMB services,” the authority said through its website.
Using the improved payment system, NCAA says people who possess a Visa or Master Card can use the same to pay for entry and all other fees payable to the NCAA subject to additional service charge of 1.5 per cent of the respective authority’s fees.
It has also requested its customers to take necessary initiatives in acquiring the new cards from the NMB Bank to avoid unnecessary inconveniences, effective from early next month.
In the recent past, tour operators have been vocal over NCAA's electronic payment system, saying it caused a lot of inconveniences.
The authority uses smart cards to collect its revenue electronically. The electronic system reduces risks of carrying cash and cheques while visiting Ngorongoro Conservation Area.
The system also increases efficiency through reducing unnecessary queues and delays at the gate before entering the Ngorongoro Conservation Area.
